THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY (THE “REELCOMP PRIVACY POLICY”) GOVERN THE MANNER AND MEANS IN WHICH REELCOMP INC., (“REELCOMP”) COLLECTS, STORES, AND USES THE PERSONAL INFORMATION OF OUR customers, visitors, users, and others who use or visit OR CREATE AN ACCOUNT AT WWW.REELCOMP.COM (“THE REELCOMP WEBSITE”) (each a “REELComp User”). BY USING AND/OR VISITING THE REELCOMP WEBSITE, YOU SIGNIFY YOUR ASSENT TO BOTH THIS REELCOMP PRIVACY POLICY AND THE REELCOMP TERMS OF USE WHICH ARE PUBLISHED AT REELComp.com. THE REELCOMP PRIVACY POLICY AND THE REELCOMP TERMS OF USE MAY AFFECT YOUR LEGAL RIGHTS AND YOU SHOULD READ THE FOLLOWING CAREFULLY. If you do not agree to ANY OF the POLICIES, PRACTICES OR PROCEDURES CONTAINED HEREIN, please (I) LEAVE THE REELCOMP.COM WEBSITE, (II) DO NOT CREATE AN ACCOUNT AT THE REELCOMP WEBSITE OR CONTACT REELCOMP TO TERMINATE YOUR EXISTING ACCOUNT, AND (III) do not use the REELcomp Website TO UPLOAD, STORE, OR DISTRIBUTE ANY CONTENT (HEREINAFTER “USER SUBMISSIONS”).
Please note that any User Submission posted uploaded and stored on REELComp’s systems, networks or servers and/or reproduced, published, displayed, performed or distributed via the REELComp Website at the direction of REELComp Users is not considered Personally Identifiable Information (as defined below) and is not governed by this REELComp Privacy Policy.
The REELComp Terms of Use are incorporated herein by reference and form an essential part of this REELComp Privacy Policy and describes the terms and conditions governing your use of the REELComp Website, which you should read carefully before accessing or using the REELComp Website.
The Information REELcomp Collects
REELComp collects two types of information from REELComp Users: (i) personally identifiable information that you voluntarily provide when creating an account at the REELComp Website (“User Information”) and (ii) indirect information that REELComp collects as a result of your use of, and interaction with, the REELComp Website (“Usage Information”).
User Information: When you create your account, you may be asked to provide certain personally identifiable information including, without limitation, your name and email address (“Personally Identifiable Information”) as well as general demographic information, such as age range and gender (”Demographic Information”). Your Personally Identifiable Information is not collected unless you voluntarily provide it to REELComp. You may choose not to provide your Personally Identifiable Information and/or Demographic Information and not to create a REELComp User account. However, creating an account is a prerequisite for using the full functions of the REELComp Website, including the ability to (i) direct REELComp to store, copy, distribute and display User Submissions, (ii) participate in online chats and message forums at the REELComp Website, (iii) subscribe to newsletters or other mailing lists, and (iv) enter specific User Submissions in certain contests or sweepstakes.
Usage Information: When you visit the REELComp Website, REELcomp and/or its web service provider may collect three different kinds of usage information: (i) session cookies, which are removed upon closing your browser, and persistent cookies, which may be used by your browser on subsequent visits to the site, to uniquely identify your computer, (ii) “log files” that automatically record certain information that your web browser sends whenever you visit any website, and which may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, and the date and time of your request, and (iii) "clear GIFs" or “Web Beacons” which track anonymous, aggregate online metrics such as total number of visitors and/or pages viewed, or to monitor the effectiveness of our marketing campaigns by measuring click-thru, email open, and/or response rates.
The Way REELcomp Uses Information
By creating an account with the REELComp Website, you consent to REELComp using your, User Information, including both Personally Identifiable Information and Demographic Information, and your Usage Information in any manner reasonably necessary to operate and maintain, and to provide you with the full use of, the REELComp Website. This may include the use of all or part of your User Information and your Usage Information by REELComp to track and analyze the preferences and trends of REELComp Users to improve the quality and design of the REELcomp Website and/or to create new features, promotions, functionality, and services. In addition, REELComp may use your Usage Information to (i) remember certain information so that you will not have to re-enter it during your visit or the next time you visit the REELcomp Website; (ii) provide custom, personalized content and information; (iii) track your entries, submissions, and status in promotions, sweepstakes, and contests, (iv) notify you of changes to the REELcomp Website, the REELComp Terms of Use, and/or this REELComp Privacy Policy, and (v) provide you with newsletters, emails, features, and other value-added materials. Further, your User Information and your Usage Information may both be used in connection with customer-relations correspondence and may be retained for use in evaluating and improving our customer-relations and assistance programs. We may also share your User Information and your Usage Information, as necessary, with our affiliates, as well as with unaffiliated third parties who perform services for REELComp.
The Way in Which REELcomp Does Not Use Your Information
REELComp may use your Demographic Information to identify and develop products and services that may be of interest to you and/or share this information with certain third parties for direct marketing purposes with respect to special offers, products, services, programs, promotions, surveys, publications, invitations or other opportunities that may be of interest to certain demographic groups. REELComp does not sell your User Information, including your Personally Identifiable Information, to third parties and have no intention of doing so in the future. Authorized parties with whom REELComp may share your information are subject to terms similar in intent and purpose to those in this REELComp Privacy Policy. Under the laws of some jurisdictions, you may be entitled to request disclosure regarding how REELComp shares your Demographic Information with third parties for direct marketing purposes (“Information-Sharing Disclosure”). To the extent required by applicable law, REELComp shall provide the Information-Sharing Disclosure to you upon rightful request made in writing to Privacy Officer, REELComp, Inc., 2200 S. Fort Apache #2103, Las Vegas, Nevada, 89117.
Except as otherwise described in this REELComp Privacy Policy, REELComp does not disclose or release your Personally Identifiable Information to third parties; provided that, to the extent permitted by law, REELComp may use or disclose Personally Identifiable Information: (i) for compliance purposes, such as immigration and customs control, security, and legal support; (ii) in connection with legal requests from government authorities or third parties pursuant to a subpoena or other legal process; (iii) if we sell or otherwise transfer assets related to the REELComp Website.
Notwithstanding the foregoing, by posting information on the REELComp Website or directing REELComp to store and publish any User Submission, you agree and acknowledge that any Personally Identifiable Information contained within such posting or User Submission or on any discussion boards, video comments, messages and chat areas, available at the REELComp Website, has been voluntarily disclosed and made publicly available for collection and use by others and may result in unsolicited messages from other parties. REELComp has no control over this use of your Personally Identifiable Information. Also, REELComp may display your REELComp screen-name to other REELComp Users who may contact you through the messages and comments section of the REELComp Website.
You can request access to your Personally Identifiable Information in order to review and edit any such information you have provided to REELComp at any time by making such request in writing to: Privacy Officer, REELComp, Inc., 2200 S. You may also opt-out of receiving communications about special offers or programs from REELComp or other information for which you subscribed by clicking on a link provided at the bottom of the email communication, and/or by emailing or calling REELComp at privacy@reelcomp.com.
When REELcomp Discloses Information
- We may provide your User Information and/or Usage Information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We require that these parties agree to process such information in compliance with the REELComp Privacy Policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.
- We may share your Demographic Information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the REELcomp Website.
- We may release your User Information and/or Usage Information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law) or respond to a court order, subpoena, or search warrant.
- REELcomp also reserves the right to disclose your User Information and/or Usage Information that REELcomp believes, in good faith, is appropriate or necessary to enforce our Terms of Use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our web site, and to protect the rights, property, or personal safety of REELcomp, our Users or others.
Your Choices
If, at any time, you do not agree with or consent to this REELComp Privacy Policy, your sole remedy is to elect not to create a REELComp User account or to terminate an existing REELComp User account. Please be aware, however, that terminating your REELComp User Account does not obligate REELComp to delete any User Information currently maintained in its systems, networks or servers. However, it is REELComp’s policy to only maintain such expired User Information and Usage Information for no longer than thirteen (13)months. Accordingly, REELComp shall make commercially reasonable efforts to delete your User Information upon its next scheduled deletion date.
Third-party Advertisers, Links to Other Sites
REELcomp allows other companies, called third-party ad servers or ad networks, to serve advertisements within the REELcomp Website. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the REELcomp Website. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see.
REELcomp provides only your Demographic Information, and does not provide any of your User Information including your Personally Identifiable Information, to these third-party ad servers or ad networks. However, if an advertiser asks REELcomp to show an advertisement to a certain audience (for example, men ages 18-34) or audience segment (for example, men ages 18-24 who have viewed certain categories of content) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of the REELcomp Website, such as the number of times you viewed an ad (but not any Personally Identifiable Information), to determine which ads to deliver to you.
You should consult the respective privacy policies of these third-party ad servers or ad networks (see links below) for more information on their practices and for instructions on how to opt-out of certain practices. The REELcomp Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or web sites.
REELcomp Incorporated does not currently utilize third party advertisers.
Our Commitment To Data Security
To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your REELComp User profile. You are responsible for maintaining the secrecy of your unique password and account information at all times.
Once your information is received by REELComp, we use commercially reasonable efforts to limit access to your Personally Identifiable Information to those employees and service providers whom we determine need access to that information to provide the requested products or services and/or other offers or opportunities that may be of interest to you. However, please be aware that your email transmissions and/or other communications to REELComp containing Personally Identifiable Information may be unlawfully intercepted or accessed by third parties and/or the may be subject to hostile network attacks or administrative errors. Also, even after your information is received by REELCOMP, we can not guarantee that your Personally Identifiable Information may not be accessed, disclosed, altered, or destroyed as a result of a breach of our commercially reasonable efforts or as a result of any other event beyond REELComp’s reasonable control. Accordingly, REELComp cannot and does not guarantee that your Personally Identifiable Information is completely secure and safe from such risks.
For the avoidance of doubt, REELComp expressly disclaims any representation or warranty, whether express or implied, with respect to ensuring, guaranteeing or otherwise offering any definitive promise of security in connection with your User Information or Usage Information.
If REELcomp learns of a security systems breach, we may use the following methods to inform you so that you can take appropriate steps; (i) posting a notice on the REELcomp Website, and/or (ii) making a commercially reasonable attempt to contact affected REELComp Users by using the email addresses such REELComp Users provided to REELComp when creating their REELComp User accounts. Additionally, depending on state law, you may have a legal right to receive notice of a security breach in writing. In order to provide such written notice, you will need to provide REELComp with your postal address using this contact form.
Our Commitment To Childrens' Privacy
REELcomp does not knowingly solicit, collect or maintain any information, either User Information or Usage Information, from persons under 13 years of age and no part of our website is directed to persons under 13. In addition, REELComp does not knowingly allow persons under 13 to register with the REELComp Website. If you are under 13 years of age, then please do not use or access the REELcomp Website at any time or in any manner. If REELcomp learns that it has collected either User Information and/or Usage Information from persons under 13 years of age without verified parental consent, then REELcomp will take the appropriate steps to delete this information. If you believe that you may have information regarding a person under 13 that you believe to be a registered REELComp User, please contact REELComp at privacy@reelcomp.com. As part of REELComp’s commitment to protecting the privacy of minors, if you are aged between 13 and 18, REELComp requests and strongly encourages, that you first obtain the permission of your parent or legal guardian before providing REELComp with any information or registering as a REELComp User.
Special Note to International Users
The REELcomp Website is hosted in the United States and is intended for and directed to REELComp Users physically located within the United States. If you are attempting to access the REELcomp Website from a physical location within the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the REELcomp Website, which are governed by U.S. law, this Privacy Notice, and our Terms of Use, you are transferring your personal information to the United States and you consent to (i) to such transfer, (ii) the application of the laws of the United States and/or the State of Nevada with respect to any dispute arising from or related to this REELComp Privacy Policy and/or your use of the REELComp Website, other than such rules, regulations, case law, and/or international treaties that would result in the application of the laws of a jurisdiction other than the United States or the State of Nevada, and (iii) the exclusive jurisdiction of the courts of the United States or the State of Nevada. Any claim or dispute between you and REELComp that arises in whole or in part from the REELComp Website or in connection with this REELComp Privacy Policy shall be decided exclusively by a court of competent jurisdiction located in Las Vegas, Nevada. Each party hereby agrees that such court shall have in personam jurisdiction and venue with respect to such party, and each party hereby submits to the in personam jurisdiction and venue of such courts and waives any objection based on inconvenient forum.
In the Event of Merger, Sale, or Bankruptcy
In the event that REELcomp is acquired by or merged with a third party entity, REELComp may transfer or assign the information we have collected from REELComp Users as part of such merger, acquisition, sale, or other change of control.
In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.
Changes and updates to the REELComp Privacy Policy
REELComp may revise this REELComp Privacy Policy. The date of any such revision shall be reflected by the "effective date" below. Please revisit this page to stay aware of any changes. The use of both your User Information and your Usage Information shall be governed by the REELComp Privacy Policy then in effect. In the event that REELComp does amend this REELComp Privacy Policy, REELComp shall provide you with general, not specific, notice of such changes by posting a conspicuous announcement on the REELComp Website homepage that (i) such changes or amendments have occurred, and (ii) identifying which particular provisions have changed. Such announcement shall be maintained for no less than [30] days following the effective date of such amendment. Your continued use of the REELComp Website following the posting of such announcements will signify and be deemed your assent to and acceptance of the revised REELComp Privacy Policy.
If, and only if, REELComp makes revisions to the REELComp Privacy Policy that result in a material lessening of the restrictions on REELComp’s use or disclosure of your Personally Identifiable Information, REELComp will make a commercially reasonable attempt to obtain your consent before implementing such revisions with respect to such Personally Identifiable Information.
If you disagree with the terms of any REELComp Privacy Policy at any time, your sole remedy is to terminate your use of the REELComp Website and Your REELComp User account.Continued use of the REELcomp Website constitutes your agreement to any REELComp Privacy Policy as in effect.
